If you're unlawfully sacked you can sue your bosses. Jenny did & won

* If you're unlawfully sacked you can sue your
bosses. Jenny did & won
People get sacked indiscriminately in this country
and they don't know that they can actually sue
and get compensated. Jennifer Adighije Okolo, the
creative director of House of Silk, sued her former
bosses and won. According to a report by Maestro
Media, an Industrial Court sitting in Ikoyi, Lagos
gave a ruling in favour of Jennifer against her
former employer, Helios Towers, a telecom firm.
In the court ruling, the Telecom firm would
need to pay, Jennifer Adighije-Okolo N13.55
million for unfairly terminating her
employment. Jennifer before the sack was the
company's Head of Operations & Planning.
The Company had terminated their former
employee's appointment for what they had
termed poor performance (performing below
par), Jennifer not satisfied with how she was
sacked had taken the company to the Industrial
Court, Ikoyi, Lagos seeking for redress. The end
result of the case is her winning #9 Million
which is the sum total of her salary from
between February 1, 2010 to January 31, 2012.
Apart from the #9 Million, the defendant would
also be paying the claimant another #4.5
Million for damages and also awarded in the
claimant's favour is another #50,000 cost.
According to Jennifer, she had been graded
excellent by her immediate boss in her yearly
appraisal, only for another appraisal body (the
management review team) to have given an
appraisal of below average, consequent upon
which her appointment was terminated.
In his Judgement, Justice O. Abaseki-Osaghae said
- The claimant testified as the only witness in
support of her claims. She also stated that her
performance was very much appreciated by the
defendant that when there was a job rotation, she
was asked to take charge as Head, Operation/
Planning in September 2009. That all through her
employment with the defendant, she was
conscious of her personal objective with the
defendant company, which she knew would form
the basis of her rating in the annual appraisal.
"It is the law that an employer is not bound to
give reason for terminating the appointment of its
employee but where the employer gives a reason,
the law imposes on him a duty to establish the
reason to the satisfaction of the court.
“I find that the said management review team
was acting out a script when, spitefully,
maliciously and without any basis, wrote on the
claimant’s appraisal form ‘Below expectation’ and
recommended that her appointment be
terminated.”
The court upheld the claimant’s position that she
was entitled to compensation, since she signed
the restrictive covenant, not to work for any other
telecommunication company, until after two years
of her leaving the company. “She has kept to
this covenant. I, therefore, award the sum of
N9million as compensation being her salary for
two years from January 2010 to January 31, 2012
pursuant to section 19 (d) of the National
Industrial Act, 2006.
“For all the reasons given above, I find that the
claimant has proved her case. I hereby, declare
and make the following orders: the claimant’s
employment with the defendant was wrongfully
terminated. The letter of termination is hereby set
aside. The reason given in the termination notice
written by the defendant that the claimant’s
“performance has failed to meet acceptable
standard” is false and malicious.
“The defendant is to pay the claimant the sum of
N4.5million as damages for wrongful termination
of her appointment. The defendant is to pay the
claimant the sum of N9million as compensation
for the period February 1, 2010 to January 31,
2012. The sums are to be paid within 30 days
from the date of this judgment. I award in favour
of the claimant cost of N50, 000 to be paid by the
defendant. Judgment is entered accordingly.”

Sad at 53! Death Toll Rises To 78 In Yobe College Of Agriculure Student Attack

* Still counting with many more people still
unaccounted for as the death toll rises to 78 in
Yobe College of Agriculure. Early hours of
yesterday, students were attacked, some were
shot, others were butchered with swords and
knives. The gunmen, suspected to be Boko
Haram sect members later moved to houses
around the hostel, killing residents they find.
They also blocked the Damaturu-Maiduguri road
and killed travellers.
Read below what a student of the college who
survived the massacre said…
“They started gathering students into groups
outside, then they opened fire and killed one
group and then moved onto the next group and
killed them. It was so terrible. They came with
guns around 1a.m. and went directly to the
male hostel and opened fire on them. The
college is in the bush, so the other students
were running around helplessly as guns went off
and some of them were shot down.”
The gunmen stormed the hostels in two double-
cabin pickup all-terrain vehicles and on
motorcycles, and were dressed in military
camouflage. They attacked 4 male hostels but
avoided the only hostel reserved for girls.
Swords and knives were used to kill at least 30
male students. Some corpses that were found
were without heads while others had heads
hanging to the bodies. Wailing parents and
relatives were at the Sani Abacha Specialist
Hospital mortuary in Damaturu this morning to
identify their loved ones. This can’t continue.
This government has to do something about the
situation

“Who Cares If Jim Iyke Is Possessed With 99 Demons” – Bianca Johnson Blasts TB Joshua & Nigerians

* Bianca Johnson Blasts TB Joshua & Nigerians Over
Jim Iyke’s Deliverance From Evil Spirits “Who
Cares If He’s Possessed With 99 Demons”
Bianca Johnson, a Nigerian socialite is speaking up
24 hours after Nollywood actor Jim Iyke claims he
was delivered at controversial prophet TB Joshua’s
church in Lagos.
Concerned about Boko haram’s recent attack
in yobe, the beautiful woman took to her social
networking page to blast Nigerians for going viral
with Jim Iyke’s deliverance story instead of
focusing on the real problem facing the country
Check out what Bianca wrote few hours ago;
“Actor Jim Iyke went to TB Joshua to get
deliverance and it went viral…same day Boko
Haram militant shot and killed over 60 students in
Yobe college dorm while they sleep, Nigerians
swept it under the rug, business as usual. Who
gives a damn if Jim has 99 demons…I guess 60
innocent and harmless dead bodies are not as
sensational as Jim Lyke. May their souls rest in
peace. Amen!”
While we all expect Jim Iyke to speak at length on
his experience at TB Joshua’s church, he simply
took to his Twitter page to say;
“Its Beautiful that’s d least I can say. Nothing else
truly matters. Absolutely nothing! God liveth
whether you’re a believer or not.
Met more miserable billionaires than unhappy mid
income earners.Success is relative.I want it
wholesome. Is either ur bond or free”

* MESSAGE TO OUR LOVE ONES
i was told that with time Life will break you. Nobody can protect
you from that, and living alone won't either,
Death ends a life, not a relationship.”
So why not create a memory which you won't be forgotten, touch a soul, make an impact who knows if tomorrow will start with or without you but
When tomorrow starts without me,
and I'm not there to see;
If the sun should rise and find your eyes,
all filled with tears for me;
I wish so much you wouldn't cry,
the way you did today,
while thinking of the many things,
we didn't get to say.
I know how much you love me,
as much as I love you,
and each time that you think of me,
I know you'll miss me too;
But when tomorrow starts without me,
please try to understand,
that an angel came and called my name,
and took me by the hand,
and said my place was ready,
in heaven far above,
and that I'd have to leave behind,
all those I dearly love.
But as I turned to walk away,
a tear fell from my eye,
for all life, I'd always thought,
I didn't want to die.
I had so much to live for,
so much yet to do,
it seemed almost impossible,
that I was leaving you.
I thought of all the yesterdays,
the good ones and the bad,
I thought of all the love we shared,
and all the fun we had.
If I could relive yesterday,
just even for awhile,
I'd say good-bye and kiss you
and maybe see you smile.
But then I fully realized,
that this could never be,
for emptiness and memories,
would take the place of me.
And when I thought of worldly things,
I might miss come tomorrow,
I thought of you, and when I did,
my heart was filled with sorrow.
But when I walked through heaven's gates,
I felt so much at home.
When God looked down and smiled at me,
from His great golden throne,
He said, "This is eternity,
and all I've promised you".
Today for life on earth is past,
but here it starts anew.
I promise no tomorrow,
but today will always last,
and since each day's the same day,
there's no longing for the past.
But you have been so faithful,
so trusting and so true.
Though there were times you did some things,
you knew you shouldn't do.
But you have been forgiven
and now at last you're free.
So won't you take my hand
and share my life with me?
So when tomorrow starts without me,
don't think we're far apart,
for every time you think of me,
I'm right here, in your heart.
It is the unknown we fear when we look
upon death and darkness, nothing more.”
Do not pity the dead, Pity the
living, and, above all those who live without
love.and for those that left without saying goodbyes we love and miss you all

Jim Iyke’s Mother Has Stroke, Admitted At Lagos Hospital.

* If the story making round is anything to go by, the
mother of Nollywood actor Jim Iyke might be in a
serious medical condition.
According to gossips, Jim Iyke’s mum is currently
clinging to life at a private hospital in Lagos after
her battle with high blood pressure turned to
stroke.
A quick check on Jim Iyke’s Twitter profile
revealed nothing of such.
Last year, an Abuja-based socialite Hajia
Abubakar blasts the actor for duping him of N15
million, a money she claims the actor used for the
treatment of her mother who battled leg problem
and high blood pressure.
Let’s wait until we get some solid confirmation
from the actor himself but all we know is that Jim
Iyke’s mum has been admitted in a private
hospital in Lagos for stroke.

Banky W Thinks There's More FAME In Entertainment Industry Than MONEY

* The 10 Bankable artiste's list by Forbes has
generated a lot of controversies, but Banky W
managed to stay out of it. Though he was listed
among the 10 Nigerian bankable artistes, Banky W
said this to Nigerian Tribune when he was asked
about what he thinks about the list;
I don’t believe very much in such things. Let’s be
honest, the real wealthy people are the
businessmen like Dangote and the politicians
(some of whom got there by looting Nigeria).
They’re the ones with real money. This
entertainment business is too much hype. It is
more fame than fortune. So I’m not thrilled to it
and I don’t think any of us should buy into it too
much. I’d rather be wealthy and quiet than
famous and broke.

‘I May Not Live Long’ – Kunle Afolayan Shocks Fans

* Actor cum movie producer Kunle Afolayan instilled
fear in the hearts of his fans with his recent
message on his Facebook page.
The workaholic filmmaker said he is afraid he may
no live long due to his obsession with film making.
Just coming off the set of his soon-to-be-released
epic movie, ‘October 1’, the workaholic filmmaker
took to Facebook to post his thoughts.
Read what he wrote:
”My Obsession with filmmaking makes me
think I may not live long. I forbid it though. I
got back to Lagos yesternight very tired and
sleepy after 42days of shoot, got home ate
then went to bed. All I see through out my
sleep are the shots I took and those that I felt
I should have done differently. Woke up this
morning and all I have in my head is the
deadline of the Trailer release which is
October 1 2013, in about 11 days and the
completion of the whole project. Yes, am
very passionate about film making but I think
being too obsessed is not healthy”.
It was however gathered that the movie has
already gulped a staggering sum of
N100million and about N200million is still
needed to see the movie to completion

MUST READ: SECRETS

* What if i tell you that lies and secret are just like brothers, they are like cancer in the soul, most people are not what you thought they are, they are what they keep in mind about themselves but is there anything like secret? let's look into this
She was a beautiful young woman, just into her twenties. Happy, outgoing and extremely friendly, Kelly had no trouble making friends. She was little
more than a year from completing college and her dream job would be awaiting when she finished.
But now, for the first time in her life, things were in total disarray. Her boyfriend of several years had just broken off the relationship as he chose to
take a job offer half way across the country. What he didn't know was that he would not only be leaving Kelly behind, but he would be leaving a
daughter behind too.
Weeks before her boyfriend moved away, Kelly suspected she was pregnant, but didn't want to further disrupt things by saying anything. She
knew that while she had loved her boyfriend, they
would both be able to move on to independently
forge happy and successful lives. After having
confirmed her suspicions about being pregnant
she took some time to contemplate. She had met
with several doctors and finally decided it would
be best to quietly end the pregnancy. A few weeks
later, after having researched her options, she
went in for an abortion and came out assured that
she had made the right choice.
Kelly eventually got married and did in fact build a
happy family. No one ever knew her secret, but it
was best that way. At times she did think about
the past and the daughter she almost had, but for
the most part, life was good to Kelly. This
afternoon, things changed.
Kelly was on her way to pick up her two teenagers
from school when her car was side-swiped by a
semi-trailer. No seatbelt or airbag was a match for
the blunt force that likely killed her instantly.
Kelly's story doesn't end here.

Today, death found Kelly and she indeed stands
before God in heaven. It is her judgment day - a
day in which we all must face God and answer to
Him for our life on earth. For the first time, Kelly
will look up and see the face of God the Father,
At the moment she will notice the face of an innocent child At her front. Kelly's secret was never truly hidden, and
now her own daughter asks - "Why did you kill me
mummy? Why didn't you choose to love and
accept me the way God and everybody loves and accepts you?
Without sin without offence you away life out of me, you did not even know allow me to see the image of who i am in the world why mummy? I don't know how Kelly responded to that piercing
question. I can only imagine the surprise that baby
girls' father will have when he dies and meets the
daughter he never knew he had.

ASUU STRIKE UPDATE :- Strike Continues As FG Withheld Lecturers’ August Salary

* Lecturers in the nation’s public universities on
Monday vowed to continue with their indefinite
strike, declaring that President Goodluck
Jonathan’s decision to withhold their salaries
would not stop their resolve to ensure the
university system is made better once and for all.
“Yes, the non-payment of our August salary is
another attempt by the government to stampede
us into breaking the strike, and as usual, it will not
work. The economic war the government is
employing has never, and will never yield any
dividend. Our next line of action is:
“To continue with the strike. We had, on July 2,
commenced a total, comprehensive and indefinite
strike action, and as long as the government does
not meet our demand of implementing the FGN/
ASUU 2009 agreement, the strike will
continue.”The Chairman, Academic Staff Union of
Universities, University of Abuja chapter, Dr.
Clement Chup, stated this in a chat with Punch.
On comments by the leadership of NANS that the
students were no longer supporting the strike,
Chup said those making the call were “political
and mercenary students.”
“The NANS that say they do not support us are the
mercenary students. They are the political, non-
matriculated students. Our genuine students do
understand the issues that warranted the strike,
and are fully in our support.”
He said government officials are only interested in
awarding contracts in universities where they will
benefit and not the quality of input and output in
the higher institutions.

NEWS: PICS+Nairobi mall attack strikes against all of us

* We just pray never to witness this type of incident again, nairobi is really on fire for 3days till this moment It's the post-9/11 nightmare that Americans
have been half expecting: al-Qaeda gunmen
attack a shopping mall, take hostages, leave
behind carnage and a sickening repeat question:
"Why us?"
Over the weekend, that scenario happened. Not
in America, but in the country where President
Obama's father was born: Kenya. A glittering,
up-market mall in the capital, Nairobi, has
looked like a violent, blood-spattered Hollywood
movie: heavily armed, well-trained gunmen
dressed in black on a rampage; hostages;
hundreds dead and injured; an utterly
overwhelmed police force.
The same theme and grievances as 9/11 are
woven through this horror. The gunmen are not
from al-Qaeda; they are from a group known as
al-Shabaab in Somalia, the country that
neighbors Kenya. But the groups are affiliated.
They could almost be clones. Al-Shabaab for
years has ruled and terrorized much of Somalia,
meting out such sharia law punishment as
beheadings and stoning women to death for
adultery, even if the women had been raped.
Kenyan forces have spearheaded outside efforts
to restore some order in Somalia and drive al-
Shabaab out. They've been fairly successful.
That is why Kenya is now under the al-Shabaab
attack. This is just the latest among horrors that
have included torching Christian churches and
killing tourists.
President Obama's most effective and dramatic
move would be to go to Nairobi. He is half-
Kenyan. He has the status of a near-God there.
His influence is incalculable. He could say what
needs to be said to Kenyans, to al-Shabaab, to
Americans and to the world: Kenyans need to
stay strong and to keep forces in Somalia, not
withdraw them as the attackers want; such
attacks are painful and cowardly; the only way
to fight them is by standing firm.
Somalia next Afghanistan?
Just as important: The fight is not just a Kenyan,
or African, fight. Somalia could be the new
Afghanistan. A lawless, fundamentalist Somalia
could incubate a Somali Osama bin Laden and
new attacks on the USA, just as Afghanistan
protected and nurtured bin Laden and al-Qaeda.
For a decade and a half, the warning signs have
been growing. Al-Qaeda blew up the U.S.
Embassy in Nairobi in 1998. The truck bomb
killed more than 200, and there was a
simultaneous attack on the U.S. Embassy in
neighboring Tanzania. An Israeli hotel on the
tourist beaches of the Indian Ocean was
attacked more than a decade ago.
I grew up in the region in the dying days of the
colonial empire and already sensed back then
the religious and tribal forces that could be
unleashed. An imaginative future al-Shabaab
attack on the U.S. is even the premise of a novel
I am finishing.
There is a catch to an Obama Kenya trip. A
Catch-22.
Kenyan President Uhuru Kenyatta is accused of
war crimes for allegedly inciting violence after
elections in 2007, in which more than 1,000
people died. His trial at the International
Criminal Court is set for November. An Obama
trip could be seen as supporting Kenyatta,
undermining the charges.
Benefits of Obama visit
The benefit, though, would outweigh this risk.
Obama could focus attention on the charges,
too, and underscore how volatile and difficult the
whole region is, and how much the U.S. needs to
focus on it. Kenya has long been considered an
oasis of stability on a violent continent. Kenyatta
is the son of the revered first post-colonial
president, Jomo Kenyatta.
The Nairobi shopping mall attack is
heartbreaking. The stories could so easily be
American stories. A popular radio host killed
where she had earlier posted photos onto her
Instagram account. A respected, elderly poet
and professor from Ghana was also gunned
down. As the days go by, there will be more
victims identified, more grief at lives ended too
violently, too soon, as they were on 9/11.
The message of the
attackers could easily be
imagined in an attack, say, on the Mall of the
America. The attackers even called for Muslims
to run away. As on 9/11, they are attacking a
modern, democratic way of life. After 9/11, the
French newspaper Le Monde famously carried a
headline: We Are All Americans.
After the Nairobi attack, the message should be
"We Are All Kenyans." Not just in our sympathy.
But also in going all out to prevent another
terrorist attack.
Leaving Somalia to al-Shabab is not an option.
Author and journalist Louise Branson is a former
USA TODAY editorial writer and London Sunday
Times foreign correspondent. She is writing an
international thriller.
